ADR – Delay Claim
Project delays can cost construction firms big money. We helped our client, a national general contractor, recoup their losses after a project was delayed for over a year.
Situation
Kirwin Norris was requested to assist our client in the closeout of a public correctional facility project. The project suffered numerous and significant scheduling impacts which delayed it approximately 500 days. Our firm worked directly with our client’s project personnel (including the project manager, project engineers, superintendents, and scheduler) as well as an outside scheduling consultant in preparing a formal written claim to the county. Kirwin Norris drafted the written claim which sets forth the factual and legal basis for our client’s claim of $7 million.
Outcome
In additional to the written claim, Kirwin Norris utilized both pre-suit mediation and structured negotiations with the county to assist our client in successfully resolving this claim. Although the terms of the settlement are confidential, our client was extremely satisfied with the negotiated result without the need for litigation.
