Arbitration – Incomplete and Defective Work
Despite failing to properly and timely perform, a general contractor sued our client to foreclose a construction lien for unpaid sums and alleged extras. We not only defeated the claim, we also won a counter claim against the contractor.
Situation
Kirwin Norris represented medical professionals constructing a new medical office building. In addition to disputing that any money was owed to the general contractor, our clients claimed significant damages against the general contractor for incomplete and defective work. While the general contractor has numerous field staff to argue its position, our clients relied in large part upon expert testimony to support their claims.
Outcome
After a lengthy hearing the arbitrator found in favor of our clients, rejecting the general contractor’s claims and awarding our clients virtually their entire claim, plus interest and attorney fees.
