Bid Protest – Licensure

Kirwin Norris represented the successful bidder in defense of a protest from the #2 bidder on a $60 million roadway project.

Situation

The #2 bidder alleged numerous problems in the successful bidder’s qualifications including arguments that the successful bidder was not licensed to perform the required work of the contract. The #2 bidder sought relief at both the agency level and in federal court through the aggressive prosecution of a motion for preliminary injunction.

Outcome

Through detailed research, analysis, and written and oral advocacy, Kirwin Norris was able to convince both the agency awarding the contract and the federal court that the client was properly licensed and the lowest responsive and responsible bidder, resulting in the ultimate award of the contract to our client.
